Woolworths Returns Gift Cards changes effective 1 November 2019

Returns Gift Cards issued in store after 1 November 2019 will have no expiry date.
Effective 1 November 2019 any valid Returns Gift Cards with an issue date after 1 April 2019 will have no expiry date, even if they are pre-printed with a shorter expiry period.

Please note, Returns Gift Cards issued prior to 1 April 2019 will not be refunded, replaced or reissued unless required by law.

Woolworths Gift Cards and eGift Cards sold online and in store after 31 March 2018 will have no expiry date, even if they are pre-printed with a shorter expiry period.

Woolworths Gift Cards and eGift Cards with an issue date after 31 March 2017 will have no expiry date, even if they are pre-printed with a shorter expiry period.

Changes to our eGift Card products effective 21 October 2020

What are the Branded eGift Cards redemption changes?

As we continue to expand on our Gift Card offerings to provide our customers with more variety and loyalty rewards, we have made some important and necessary changes to the Woolworths Gift Cards program.

Please note that as of 21 October 2020, when you purchase a Branded eGift Card from our website, it will only be redeemable within the brand for which the eGift Card is branded.

This means,

BIG W eGift Cards will only be redeemable at BIG W, online and in store.
Woolworths eGift Cards will only be redeemable at Woolworths Supermarkets & Metro, online and in store.
BWS eGift Cards will only be redeemable at BWS, online and in store.
Dan Murphy's eGift Cards will only be redeemable at Dan Murphy's, online and in store.
Cellarmasters eGift Cards will only be redeemable at Dan Murphy's, online and in store.

We appreciate that previously, some Woolworths Branded eGift Cards have been redeemable across all Woolworths Group participating stores.

This change does not apply to physical Branded Gift Cards^* purchased before 21 October 2020. These physical Gift Cards will continue to be subject to the WISH Gift Cards Terms & Conditions.

These terms and conditions are important and you should read them fully. But there are some specific terms we wanted to make you aware of. These are set out below.

We may change the minimum and maximum amounts that can be loaded on Cards at any time. If we do so, we’ll give you notice via our website (see clause 5.1 for more details).
Without excluding, restricting or modifying your rights under the Australian Consumer Law (and any other non-excludable statutory right) our liability to you in all other cases will be limited to refund or reissue of your Card up to the value of your purchase. We will not be liable for indirect or consequential loss arising from or connected to your Card and our liability to you for loss or damage related to or in connection with your Card will be reduced to the extent you cause or contribute to the loss or damage (see clauses 10.2 and 10.3 for more details).
You agree to indemnify us against any claim, damages or expenses we suffer in connection with the use of your photo or other media, including any infringement of another person’s intellectual property rights or unauthorised use of any image of any other person (see clause 4.9 for more details).
The resale, marketing, advertising or other promotional activities related to or of a Card is prohibited without our prior written consent. If you do so without our prior written consent, your Card may be considered invalid and we are not obliged to allow you or the Recipients to use or Redeem the Card Balance on these Cards (see clauses 6.5 and 11.1 for more details).

Terms and Conditions

1. Definitions

In these terms and conditions:

"Access Code" means:

a) in relation to a Physical Card, the 4-digit number on the back of the Physical Card; and
b) in relation to an eGift Card, the 4-digit number that appears on the eGift Card, which is required to make a transaction or transaction enquiry.

"Activate" means the initial loading of value onto a Card, and "Activating" and "Activated" have corresponding meanings.

"BIG W Store Credit" means a Card issued by us with the designation "BIG W Store Credit".

"Bonus Store eGift Card" means one of the following gift cards issued by us to you on a bespoke basis either as a Physical Card or an eGift Card:

a) Woolworths Supermarket Bonus Store eGift Card;
b) Woolworths Online Bonus Store eGift Card;
c) BIG W Bonus Store eGift Card;
d) BWS Bonus Store eGift Card;
e) Cellarmasters Bonus Store eGift Card (gift card not available for purchase from 9th June 2021);
f) Dan Murphy’s Bonus Store eGift Card;
g) WISH Bonus Store eGift Card;
h) Everyday WISH Bonus Store eGift Card; or
i) EG Bonus Store eGift Card.

"Card" means a card described in these terms and conditions (in Physical Card or eGift Card form, as may be applicable), and for the avoidance of doubt includes:

a) BIG W Bonus Store eGift Card
b) BIG W Store Credit
c) BIG W Store eGift Card

"Card Balance" means the unspent value of a Card.

"Card Number" means:

a) in relation to the Physical Card, the 19-digit number that appears on the back of the Physical Card; and
b) in relation to the eGift Card, the 19-digit number that appears on the eGift Card.

"Customer Loyalty Program" means a customer loyalty or rewards program managed by us or by a third-party.

"Digital Channel" means the Website and any other channel on which a Your Pick Gift Card is digitally available.

"Dispatch Date" means the date the eGift Card was emailed to the Recipient of the eGift Card.

"eGift Card" means a Card issued in 'electronic' form.

"Essentials Card" means a Card issued by us with the designation "Essentials".

"Everyday Rewards App" means the mobile application that allows users to access Everyday Rewards.

"Everyday Rewards" means the customer loyalty program which Woolworths Group Limited operates throughout Australia.

"Expiry Date" means:

a) for Your Pick Gift Cards, the date being 36 months from the date of purchase of a Your Pick Gift Card, after which any remaining funds on a Your Pick Gift Card will not be available for Redemption and will be forfeited;
b) for Bonus Store eGift Cards, 3, 6, 12 or 36 months from the date of issue of the Bonus Store eGift Card as specified on the front of the Bonus Store eGift Card, after which time any remaining funds on a Bonus Store eGift Card will not be available for Redemption;
c) for Monty's Rewards Gift Cards or pub+ Rewards Gift Cards purchased on or after 31 March 2017, the date on which the Monty's Rewards Gift Card has a Redeemable value of zero;
d) for Monty’s Rewards Gift Cards purchased prior to 31 March 2017, the date being 12 months from the date of purchase of the Monty’s Rewards Gift Card or 12 months from the Dispatch Date of the eGift Card, after which any remaining funds on a Monty’s Rewards Gift Card or eGift Card will not be available for Redemption.
e) for cards that are labelled “Returns Gift Cards” (Returns Gift Cards) issued on or after 1 April 2019, the date on which the Returns Gift Card has a Redeemable value of zero;
f) for Returns Gift Cards issued prior to 1 April 2019, the date being 6 months from the date of issue of the Physical Gift Card, after which any remaining funds on a Returns Gift Card will not be available for Redemption;
g) for Cards purchased on or after March 2017 and not otherwise listed in this clause, the date on which the Card has a Card Balance of zero dollars;
h)for Cards purchased prior to 31 March 2017, the date being 12 months from the date of purchase of the Card, after which any remaining funds on a Card will not be available for Redemption;
i) for WISH Gift Cards purchased on or after 31 March 2017, the date on which the WISH Gift card has a Redeemable value of zero;
j) for WISH Gift Cards purchased prior to 31 March 2017, the date being 12 months from the date of purchase of the Physical Gift Card or 12 months from the Dispatch Date of the eGift Card, after which any remaining funds on a WISH Gift Card will not be available for Redemption;
k) for Woolworths Store Credit and BIG W Store Credit, the date being 36 months from the date of issue of Gift Card, after which any remaining funds on a Woolworths Store Credit and BIG W Store Credit will not be available for Redemption and will be forfeited; and
l) for the Woolworths Supermarket & BIG W eGift Card, the date being 36 months from the date of issue of Gift Card, after which any remaining funds on The Woolworths Supermarket & BIG W eGift Card will not be available for Redemption and will be forfeited.
m) for Employee Benefit eGift Cards, the date being 36 months from the date of issue of an Employee Benefit eGift Cards, after which any remaining funds on an Employee Benefit eGift Cards will not be available for Redemption and will be forfeited.

"Gift for Good Card" means a Card issued by us with the designation "Gift for Good".

"Monty's Rewards Gift Card" means a Monty's Rewards Gift Card issued by us.

"Participating Retailer" means any channel or store that a Card is available to be Redeemed for, as amended from time to time.

"Participating Store" means a store listed on the Website as a store which accepts payment using the Card (as may be applicable for each Card, and as amended from time to time)

"Personalisation" means a message or other media sent to a Recipient with a Card.

"Physical Card" means a Card issued in conventional plastic card form.

"pub+ Rewards Gift Card" means a pub+ Rewards Gift Card issued by us.

"Recipient" means the person who receives a Card as the case may be (and for the avoidance of doubt may be the same as the purchaser).

"Redeem" means to reduce the value loaded on a Card by using it to purchase goods or services, and "Redeemable", "Redeemed" and "Redemption" have corresponding meanings.

"Returns Card" means a Returns Card issued by us.

"Simply Groceries Card" means a Card issued by us with the designation "Simply Groceries".

"Website" means the platforms on which the Gift Cards are sold in Australia (as may apply from time to time), including www.everyday.com.au/gift-cards and atwork.woolworths.com.au/business-solutions/gift-cards/.

“Woolworths Store Credit” means a Card issued by us with the designation "Woolworths Store Credit".

"Your Pick Gift Card" means any Your Pick Gift Card issued in electronic form by the Card Issuer with the designation "Your Pick Gift Card".

A reference to "we", "us" or "our" is a reference to Woolworths Group Limited.

A reference to "you" or "your" is a reference to the person who is taken to agree to these terms and conditions under clause 2, and includes any purchaser or Recipient of a Card.

A reference to "$" or "dollar" is a reference to an Australian dollar.

2. Agreeing to the terms and conditions

2.1 These terms and conditions apply to each Card.

2.2 You agree to be bound by these terms and conditions by purchasing, activating, using, or attempting to use a Card, or by making a transaction enquiry or exercising any right to Redeem value loaded on a Card.

2.3 In addition to these terms and conditions, you agree to be bound by any additional product terms and conditions that apply to the Card that you purchase.

2.4 By purchasing, activating, using or attempting to use a Card, or by making a transaction enquiry or exercising any right to Redeem value loaded on a Card, you warrant to us that you will comply with these terms and conditions and all applicable laws and that the Card will not be used in any manner that is unlawful, misleading, deceptive, unfair or otherwise harmful to consumers.

2.5 If you are giving a Card to another person, you should ensure that the Recipient is aware of the terms and conditions that apply to the Card and the relevant Expiry Date of the Card.

3. Purchasing a Card

3.1 You can purchase Cards online at the Website or from Participating Stores, unless otherwise specified in these terms and conditions.

3.2 When purchasing a Card, payment can be made using the available payment options on the Website from time to time. Payment is required (including payment clearance) prior to the Card being dispatched.

4. Personalising an eGift Card

4.1 You warrant that you will only submit a photo, image, or other media that you own copyright in, have the copyright owner’s permission to produce (permission may be given by a parent or guardian on behalf of a minor) or does not infringe any third party’s personal or intellectual property rights.

4.2 If we find inappropriate, offensive or otherwise objectionable messages or other media that does not comply with these terms and conditions, we reserve the right to remove the offending message and / or media and apply a default eGift Card message and/or image to the eGift Card. Offending material includes, but is not limited to:

a) Potentially offensive material that promotes racism, bigotry, hatred or physical harm of any kind against any group or individual;
b) copyrighted or trademarked material not owned by you;
c) abusive, threatening, obscene, defamatory or libellous statements or imagery;
d) political or religious imagery which is offensive to cultural values;
e) pornographic or sexually explicit material of any kind; and
f) advertising or promotional materials or branded products.

4.3 You can use a company logo for an eGift Card if you are the holder of the intellectual property rights of the company logo.

4.4 By submitting a photo, image, or other media for Personalisation of the eGift Card, you grant us and our subcontractors a royalty free, unrestricted right to use or reproduce such photo, image, or media for the purpose of the production of the eGift Card.

4.5 Variations in colour and quality of the photo, image or media on the eGift Card provided may occur in the finished product. You acknowledge that the finished photo, image or media is dependent on the quality submitted.

4.6 You agree to indemnify us against any claim, damages or expenses we suffer in connection with the use of your photo or other media, including any infringement of another person's intellectual property rights or unauthorised use of any image of any other person.

5. Loading value to a Card

5.1 A minimum and maximum value can be loaded onto a Card, as specified for each Card type. The minimum and maximum value amounts may change at our discretion, and we will provide notice of such amounts on our Website.

5.2 There may be a delay between when you pay for a Card and when the Card is activated by our point of sale system. During the period of delay, the Card cannot be used to make purchases or transaction enquiries.

6. Redeeming your Card

6.1 Your Card can be Redeemed at Participating Stores in Australia up to the value loaded onto the Card. Value Redeemed is deducted from the Card Balance.

6.2 Where the price of the goods or services being purchased with a Card exceeds the Card Balance, you must pay the amount exceeding the Card Balance by an alternative payment method at the discretion of the relevant Participating Store.

6.3 Cards cannot be used at stand alone photo kiosks, DVD vending machines and mobile EFTPOS terminals.

6.4 Cards cannot be refunded or used to obtain cash. You cannot use your Card to make a credit card payment or other transaction account deposits.

6.5 If a Card is able to be Redeemed at multiple Participating Stores or swapped to eGift Cards that can be Redeemed at multiple Participating Stores, we may impose limits on the number of eGift Cards that can be Redeemed per redemption.

6.6 You may not be able to Redeem a Your Pick eGift Card if your Card Balance is less than $1. Subject to any consumer law requirements, if your Card Balance reduces below $1 in relation to a Your Pick eGift Card, you cannot access or request those funds be returned to you and you forfeit those funds to us.

6.7 You may not be able to Redeem your Card on all products. For example, some Cards cannot be used to make donations, or purchase tobacco products, liquor, lotto or lottery products, charity products, home brew products, gift cards and vouchers, motor oils and lubricants or other products we notify you from time to time. If your Card cannot be Redeemed on certain products, we will notify you of this prior to purchase.

6.8 Your use of a Card at a Participating Store is at all times subject to the policies (and where applicable, other terms and conditions) of that Participating Store regarding the goods and services made available by it. For example, if you are under the age of 15, a Participating Store may not supply you with video games or other material classified as being MA15+.

6.9 Resale of Cards is strictly prohibited, except with our prior written consent. Cards that are resold in breach of this clause may be considered invalid, and we are not obliged to allow the Recipients of those cards to use or Redeem unspent value on their Cards. If approved, Cards cannot be resold for more than the original purchase price.

7. No Reloading a Card

7.1 After a Card has been Activated you cannot subsequently reload or add value to it.

8. Transaction Enquiries

8.1 You can check your Card transaction history and Card Balance by:

a) Visiting the Website;
b) Calling 1300 10 1234; or
c) Downloading the Everyday Rewards App from the Google Play™ or App store™.

8.2 To make a balance enquiry on your Card as set out above, you must provide your Card Number and Access Code when prompted.

9. Lost or Stolen Cards

9.1 If your Card is damaged, lost or stolen, please contact us.

9.2 We reserve the right to place a stop on your Card if:

a) you report that your Card has been lost, stolen, damaged or deleted;
b) we believe (or reasonably suspect) that you have used (or will use) your Card contrary to these terms and conditions; or
c) we believe (or reasonably suspect) that there is an error with your Card.

10. Liability

10.1 You are responsible for the security, use and safety of your Card. Please be careful of scams and note we do not take any responsibility where you give access to your Card to a third party in a manner that is not in accordance with these terms and conditions.

10.2 Without excluding, restricting or modifying your rights under the Australian Consumer Law (and any other non-excludable statutory right), our liability to you in all other cases will be limited to refund or reissue of your Card up to the value of your purchase. We will not be liable for indirect or consequential loss arising from or connected to your Card in contract, tort, under any statutes or otherwise (including without limitation, for loss of revenue, loss of profits, failure to realise expected profits or savings, loss or corruption of data and any other commercial or economic loss of any kind) unless such loss arises as a result of our own negligence or wilful misconduct.

10.3 Our liability to you for loss or damage of any kind arising out of or in connection with these terms and conditions or your Card is reduced to the extent (if any) that you cause or contribute to the loss or damage. This reduction applies whether our liability is in contract, tort (including negligence), under any statute or otherwise.

11. Relationship with Us

11.1 Cards may be used as personal or business gifts, but must not be used in connection with any marketing, advertising or other promotional activities unless you obtain our prior written approval. Cards that are used in marketing, advertising or other promotional activities in breach of this clause may be considered invalid, and we are not obliged to allow the Recipients of those cards to use or Redeem unspent value on their Cards.

12. Errors and complaints

12.1 If you have questions or if you wish to make a complaint about your Card, contact us via:

a) the ‘Contact us’ section of the Website; and/or
b) our Customer Service Team on 1300 10 1234.

13. Updates to Terms

13.1 We may update these terms from time to time. The latest terms will be published on our Website.

13.2 If we consider that a variation is likely to have a material detrimental impact on you, we will provide reasonable prior notice of such change.

13.3 Your continued purchase, activation, or use of a Card following the effective date of a variation constitutes your acceptance of the amended Terms and Conditions.
